Commission retreats to Machakos to review Election Campaign Financing regulations

The Commission, with support from Transparency International Kenya, is holding a workshop in Machakos county to review the Election Campaign Financing regulations.

Campaign financing, which is a key focus area in the electoral legal reform agenda, is responsible for setting contribution and spending limits pursuant to Section 5(b) of the Elections Campaign Financing Act, 2013.

In the 2017 and 2022 General Elections, the Commission set contributions and spending limits, but were not approved by the National Assembly and thus not implemented. Following the 2022 revocation, Katiba Institute filed a case challenging Parliament's resolution and certain provisions of the Act.

While delivering its ruling in the matter, the Court directed the Commission to develop Regulations, subject them to public participation and put in place structures to set Contribution and Spending Limits pursuant to Section 5(b) of the Elections Campaign Financing Act, 2013.

Mr. Obadiah Keitany, the Deputy Commission Secretary in charge of Support Services, underscored the significance of collaborative endeavors in shaping the democratic landscape. The Court in its judgment directed the Commission to proactively and timeously come up with the Regulations contemplated under Article 88(4)(i) of the Constitution so that this country has in place the requisite Regulations and the necessary spending limits. In doing so, the Commission will be promoting constitutionalism.

“The Commission appreciates the tireless and committed engagement of Transparency International- Kenyan Chapter on the issue of implementing the Elections Campaign Financing Act, 2013,” said Keitany.

The DCS lauded the Directorate of Legal Services for the vital role it plays in the enactment of electoral laws and regulation, which have enabled the Commission to deliver on its Constitutional mandate.
